Legal Question in Employment Law in Nevada

leave of absence

I have one employee. She has asked for a three-month leave of absence due to family illness. I am planning on giving it to her; she is going to pay for her own health insurance. Do I have an option of not re-employing her at the end of the three months? Her husband has a terminal illness...he may be worse then, and she will have to extend the time. Our office is very small and her position is very critical to our business.

Basically, what are my legal options in this matter regarding her employment or termination at the end of the leave..???

Your options concerning terminating an employee on family leave depend on whether your company is subject to the FMLA laws.
