Property Damage at a party

if an adult holds a party and serves alcohol to minors. a minor damages some property while intoxicated. the owner takes the minors credit card and threatens to take the issue to the authorities and will not give back the credit card. what is the legal issue with this?

The adult is wrong in withholding the minor's credit card. There are several issues in your matter.

1) If the adult held a party and knowingly served or allowed alcohol to be served on his/her premises, they are susceptible to criminal charges for contributing to delinquency of a minor.

2) The adult assumes property risk in such a situation. I would say the adult could seek restitution only if the property damage was wanton and intentional.

3) The adult's refusal to return the minor's credit card may constitute theft as well if he attempts to use it without the minor's permission.
