My rights / wrongful death lawsuit

My sons father was murdered in 2002 in Clark County Nevada, his parents have filed a wrongful death lawsuit against the convicted suspects.We were never married. Does my son have rights to the money? I am also trying to obtain social security death benefits for my minor son. Do I have rights to all the above?

Yes, your son not only has the right to make a claim as a statutory heir, but he is a necessary party. Meaning, the lawsuit should not go forward without him. Under California law your son may even sue the grandparents for not joining him in the action. See Rosenberg v. Rosenberg case (sorry don't recall the citation off the top of my head).
