Legal Question in Wills and Trusts in Nevada

What do I do next

My mother recently passed away, and although she told many of her friends she had a will, I am unable to locate it. Her home and car are financed. She had other secured and unsecured debts as well. If her estate has to go into a probate status, what is my next step to get her affairs resolved as quickly as possible?

If your Mother's assets total less than $50,000 (deducting for the debts securing her property), her estate may be "set aside without administration." This means that the Court will authorize distribution of her assets immediately once certain creditors are paid. The estate will be divided among her heirs according to law.

If her property had a net worth of more than $50,000, but was still less than $200,000, it can proceed through Summary Administration, which is an abreviated process.

Probate has a bad reputation - it isn't really so bad, except for the fact that its only needed when you've lost someone you love. Nevada has no probate or death taxes, and Court fees and costs are fairly small. If you hire a lawyer, you'll save money in the long run, and I have found that most legal fees are very reasonable for these kinds of cases.
