New Roof Leaking

New flat roof done Spring 2006 because of leaks. It started leaking December 4, 2007 in the same place as before new roof put on! I called the roof company; they came to shovel it off once saying ''it's a flat roof''. Our new roof cost thousands - and it leaks! We bought our house December 2002, the leak started December 2005, at which time the roofer tarped it for winter to replace it in Spring 2006, which was done. We lived with the old roof for 3 winters without leaks... Now after a year and a half our new roof leaks; we're not any better off than with our old roof! Is there something I can do to get my money back as well as the money I keep paying to have the roof shoveled so it doesn't leak any more? This is upsetting, costly, and seems so unfair. Please help. Thank you.

(Winter of 2006-07 new roof was fine-it hardly snowed. )

I think the key to your case would require an expert opinion as to what is the cause of the leak. That would likely be the first step in a lengthy process. Once you have a qualifed expert, then it can be determiend if there is a problem with the materials, the installation, or both. Perhaps there is some other cause. Until that is resolved, it would be extremely difficult to plan a further legal strategy.

You would be well advised to discuss all of the facts with an attorney.
