What can I do if I had a bad Photographer

What rights do I have if my photographer performed a bad job at my wedding. He was not feeling well that day of the wedding. Showed up anyways, seemed very disoriented. And the end results showed in the pictures I recieved. Some where out of focus, their are double images in a picture but in the proof book and more candid pictures than the formal ones I requested. I have requested that he replace the out of focus and double image ones, he has not yet replied to me. What if anything can I do?

First, did you have any written contract? That will determine many of your rights. If not, the problem can become one of subjective opinion. The photographer may say the pictures are fine. However, the law does impose a standard which is would a reasonable person accept these photographs?

Would other professional photographers agree that the quality is acceptable in the industry? If the answer is no, you would have a claim for money damages.
