Legal Question in Consumer Law in New Hampshire

Deposit placed on vehicle, dealer sold it within 4 days to someone else.

I placed a deposit on a vehicle, the dealer sold it within 4 days, I was approved for the financing. I searched my deposit receipt for a specific time period my deposit would hold the vehicle, there isn't one... Isn't this illegal? The dealer knew I was very interested in this vehicle, and was in the process of getting financing for the vehicle. Do I have any options?? I live in Massachusetts, the dealer is in New Hampshire.

Unless NH has a specific statute defining the length of time the dealer is required to hold a vehicle under deposit, it is likely considered to be a reasonable amount of business days and you probably should have been notified and given the opportunity to sign a contract or withdraw your deposit.

Consider retaining an attorney knowledgeable in this area of law in NH and MA or contact the Consumer Protection Division of the Attorney General's office for both states.

Almost all fifty states have their versions of Massachusetts General Law 93A (Unfair and Deceptive Practices Act - UDAP). This law covers used vehicle purchases by individuals. New Hampshire has it's own UDAP statute (Google this). Check these sites for further insight and strategy: lemonjustice.com; NCLC (National Consumer Law Center); New Hampshire UDAP statutes / attorneys, etc.; the New Hampshire Attorney General's Office; the local county DA's consumer protection office; and consumer law offices in NH and MA.

Call the Boston office of NCLC. This is a powerful resource (also visit their web site).

You may even be able to sue the dealer in a proper Massachusetts court. You'll benefit from a knowlegeable attorney here.
