Legal Question in Criminal Law in New Hampshire

Criminal Threatening

I'm a lil unsure of the details considering I was never notified by the police deptarment in question actually found out about this by my employer. Sense this is all based off of someone's word against mine, should i retain a lawyer or public defender to take my case? How can I be charged with careless operation when i was never pulled over and they have no physical proof that I was driving thatnight? What is the statute of limitations for either of these offenses? TY for your time

Re: Criminal Threatening

You probably don't have a choice as to whether to hire a private lawyer or request a public defender. A public defender is for people who cannot afford a private attorney. So if you can afford a private attorney, then you would probably not qualify for a public defender.

As far as why they charged you with Careless Operation, I have no idea. That would require reviewing the paperwork and speaking with the police any/or the prosecutor. If I tried to answer that question it would be guess work at best. And as far as not being pulled over, the police do not need to pull someone over in order to issue them a ticket or an arrest warrant. The police typically will pull a person over for a traffic violation and issue them a ticket. But if for some reason they are unable to pull them over, then they are allowed to write the ticket and give it to them at a later date.

As far as the Statute of Limitations, you will need to consult with an attorney in NH. You posted your question for SC and this question is a state-specific question. You can go back and click on NH and ask this question for an attorney from that state.

Good luck.
