Legal Question in Family Law in New Hampshire

back child support

I am 23 years old and I am seeking back child support from my father who has been absent from my life since I was 3 yrs old. I have never received a dime from him. He is living about 40 min from me and I have a phone # for him that I received from my cousin. He is not listed on my birth certificate and my mother does not want to get involved. Can you tell me my options?

Re: back child support

In the State of NH, you are not directly entitled to recover back child support yourself. Your mom must file a court action to recover the support as she is the person entitled to receive it on your behalf. There is a limitation on how long you have to recover the back support. From your question, I cannot tell if you already have an existing order for support, as your father is not on your birth certificate. If you have an order for support already, your mom could file a Petition for contempt to bring your dad back to court. If you do not have an order, then you will not be able to recover any child support payments at all.
