child support arrearage motion

In 03 I went to court for child support. At that time the master's order on the motion recommended that when my arrearage balance got to a certain amount it would be suspended. In 04 I modified because my oldest graduated. I still have one child under age. The 04 modification did not bring forward the 03 recommendation of the suspended amount of arrearage. The balance has come to the amount and now the state says that the 04 supersede the order for 03 and therefore I now owe the balance of the arrearage and it cannot be waived. Is this true? Does a modification of an eldest child delete all other master recommendations?

A proper response would require a detailed review of all the pleadings and orders. I would urge that you hire a lawyer to perform that task.

This may be a question best presented to the court for review and action. When one child is old enough that child support no longer applies to that child, then the amount needs to be recalculated as to other children. Again, this is a general rule and your particular facts may lead to a somewhat different result.
