Legal Question in Family Law in New Hampshire

Child Support NH Vs MA

I pay pay child support to my X-Wife who lives in NH and I live in MA. We both lived in MA at the time of the divorce. Now that she moved to NH does the law change? How does that work? FYI she does not work & I make less money now due to a new job.

Re: Child Support NH Vs MA

The fact your wife moved to NH does not change the law. Your divorce is still governed by MA and the court where you obtained the divorce. You can petition the court to reduce your support payments based upon a change in income.

Re: Child Support NH Vs MA

I am not sure that I completely agree. Part of the answer depends on how long the ex-wife has been living in New Hampshire with the children. It may be that by living there with the children, NH can take jurisdiction over the case, and the moving part files certain documents with the NH court. New Hampshire law regarding child support is somewhat different than Massachusetts. There are some who would say that the child support formula is more favorable to the non-custodial spouse.
