Legal Question in Family Law in New Hampshire

child support/college expenses

I have been contributing to college tuition for 4 years. My 22 year old was to graduate in May of 2008, however, decided to change his major and stay another year or two. Am I still responsible or am I done? The court has returned all exhibits and closed our file.

In order to answer your question it will require a careful review of your Decree of Divorce. The college funding question has caused a great deal of stress and confusion lately. The current law for parties now seeking divorce is that the court can not order a divorced spouse to contribute to college expenses. Under the older law it was common to have the parties agree as to how college expenses would be paid. I do no know if your divorce was granted under the old law and whether or not a judge would consider a change from a 4-year plan to an extended undergraduate education suitable for continued parental contribution.

It would be best to have an attorney review all the facts and circumstances to see if there is an agreeable method that might be appropriate to address the college expense issues.
