Already divorced...is ex in Contempt of decree??

My decree states "the parties are awarded the motor vehicle currently in HIS possession, free and clear of any right title or interest of the defendent. Each party will be solely responsible for all of the necessary maitenence and repair costs and monthly payment obligations on their respective motor vehicle and agrees to indemnify and hold the other parties harmless therefrom."

We have a car loan together. I had possession of the vehicle when the divorce was filed. When she read the decree she took the car from me. She has been late on every car payment since she took the car, affecting my She tells me I have no rights to the car and that it is none of my business. I have tried an ex-parte relief, I have tried the bank, I have even proven to the bank that she has NO car insurance and now she has hid the car from me. I went to the courthouse today to file for contempt and come to find out she has filed for a modification. What are my legal rights in NH? Is she in contempt? If not can I take her to small claims court to sue her for 1/2 the value of the car? I am at my wits end please any info you can give me is greatly appreciated.

What does your divorce lawyer say about this problem? My guess is that you did not have an attorney. If that was the case, then you got what you paid for.

Perhaps you can use some of the legal fees you saved by not having a lawyer represent you in the divorce, to bail you out of this mess now.

The agreement should have used more specificity in awarding the cars. Why didn't you protest when she took the car from you?
