Joint custody/desertion

My husband and I have agreed to divorce, the

paperwork has not been completed yet. We have

agreed to joint custody. He doesn't want to sell

our house. I have agreed to get an apartment and

he's agreed to buy me out. At what point is it ok

for me to leave the house and move into the

apartment with the kids (half the time)? I have an

apartment lined up but am afraid to sign the lease

and move out until I have something signed by

him agreeing that it's joint custody and I am not

deserting the children. Is it ok to sign a lease

before the decree is signed?

Personally, I would not commit to a lease before I had a court ordered divorce decree. Also, with kids involved, I would strongly urge you to have an attorney review your agreement before finalizing.
