Legal Question in Civil Litigation in New Hampshire

text message harrasment

My boyfriend has a cell phone plan and his ex has a phone on the account. She has been refusing to give him money towards the bill, and the few times he has called her about it, she has told him not to contact her shes not paying and if he texts her again shes filing for harassment. She has also stated she does not want the plan anymore, but won't return the phone or stop using it. He can't afford to pay the $150 to cancel her phone or the $200 in overages she made last month. Where he owns the phone/plan shes using can she file for harassment? How can he go about in collecting the money from her?

He can file a claim in small claims court for the return of the phone and costs of the bill(s).
