Legal Question in Personal Injury in New Hampshire

Car accident at fault party is insufficiently insured

Car accident totalled car and significant injuries to both my children and myself. Bills totalling over 40,000 to date and at fault (sited) party is only insured for the minimum $30,000. What are my options? Thanks!

The answer is part depends upon the law of which State the accident occurred. If NH, and you have automobile insurance ( not required in NH) then there should be uninsured coverage in the amount of your coverage. There are other options but without uninsured insurance coverage, you are fighting an uphill battle unless the person has substantial assets which is unlikely since they did not have insurance.

If you have underoinsured motorist coverage you can collect from your own insurance.

This can result in a tough situation sometimes. If you don't already have an attorney, call me. There may be another responsible party that can be sued. Or, if you or a relative have underinsured motorist insurance you can make a claim. You can also pursue the person's personal assets but frequently they just declare bankruptcy if you try that. In certain cases accepting the insurance money and negotiating down you medical bills is the best option.
