Damage to Apt. & Excessive people living in Apt.

I have a tenant who refuses to accept the rules and regulations of my rental agreement. They rented the apt. for 1 adult and 3 children. I have observed and been told that there are now 3 adults and 5 children living in the apartment. I know this is good cause to evict, but do I need to prove this, if so, how? The rentor claims no one lives there, they are just visiting. Yet they are there all the time. This same tenant also has broken windows, locks, removes outside lights, leaves hall doors opent to outside, trashes the hall and front entry way with beer cans, bottles, candy wrapers, soda bottles, etc. but claims it isn't her or her guests. I know it's her, but how do I prove it? and how can I stop it? The tenant claims it's not her. They also store things in the hall, even though I have repeatedly told them that this is a fire hazard, and not allowed. I am so frustrated, any help?

It is important first to know what you have in the lease. If the actions of the tenant are a breach of the lease, you should give them IN WRITING (certified mail) a set time (reasonable) to cease. If they do not, you must go through the eviction process exactly as it is written. If you make a mistake you will have to start all over.

You should also have an attorney review your lease so your rights a clear with the next tenant.
