Legal Question in Bankruptcy in New Jersey

Bankruptcy again after marrying

I had done a bankruptcy about three years ago to get rid of old debts from a previous divorce. Since then I have remarried and my husband and I want to do a bankruptcy for our credit card debts. Am I able to do a joint bankruptcy with my husband now, even though I did one when I was single 3 years ago? We were looking to do a chapter 7.

Re: Bankruptcy again after marrying

You must wait six years from the date you filed your last bankruptcy, in order to file a chapter 7 again. However, you may file a chapter 13 without the 6 year waiting period.
