ability to sue the electric company

i had a restaurant bar business, until the electric company shut me off september 19, 2005 it was not for non payment , but because for at least 4 years the meter was not operating properly, i had contacted the elec company on this on several occasions and they said it was not the meter it had to be something electrical in the building. i had an electrion out and they did not find a problem. i recieved a bill @ a week or 2 before they shut it off, i called to see if a payment arrangement could be made and tehy said since it was a corporation i was not entitled to a payment plan. feb 2007 i had depopsitions with their lawyers and they said we should have been offered a payment plan. the bill was for approx. 4 years back total of 33,000 dollars. since they shut me off i have lost my business and could not pay for the property thatis now going for sheriff sale. mind you every bill they did send me monthly was paid. my question is , can i go after the electric company since it is their fault i lost my business , if they would have offered me a payment plan i would not be in this situation.

Did you consult an attorney at the time of electrical shutoff?

I see several options that may have been available to you at that time, it would be difficult to determine what your current options are based on the limited info provided and your available resources.

Your attorney at the time of the suit against you would have considered the possibility of a counterclaim and applying to the court for relief consistent with the circumstances. It sounds as if the matter has been reduced to judgment. If you did not raise any claims or defenses in the original suit, it is probably too late to do that now. If you want to be sure about it, consult with a business lawyer who is close to you and give him or her all the details.
