Legal Question in Business Law in New Jersey

Can i advertise my business(online food making and delivery) without registration or completing the legal paper work?Should i register just to market my plan online? Or can i just go ahead and do marketing in social networks and other areas. will there be any legal issues?

The point of creating a proper business entity like an LLC is so you are not exposing yourself personally to liabilities. There is no requirement to form the entity, but it is prudent to do so. Many people operate what we call "sole proprietorships."

Another aspect you probably need to consider here is the trademark unless you are just using a very descriptive or generic name. But if you are branding the business you will want to conduct all your due diligence on the trademark and presumably file an application with the USPTO before you being investing in it. So for example, let's say you invest money in an online / social media campaign only to find out after you spend the money that you can't use that name because it infringes on someone else?

Before you jump in, I suggest that you consult with a lawyer in private and discuss your objectives in more detail. You can start by calling around to several for a free phone consultation, get some insights then pick the best fit to work with.

If you would like to discuss further over a free phone consult, feel free to contact me anytime that is convenient.

Our firm is now referred by the American Bar Association (see under the New York section):
