Legal Question in Business Law in New Jersey

my father invented a product in pa.sold to a company & getting % until 2049-he set up a partnership where as us kids & his wifes kids get a % yearly-he moved to florida where he passed away-his wife doesnt talk with us and we dont have access to the amounts she recieves and disperses-i have paperwork from him with the % we are to get-i would like to get a copy of the contract between my father and the company he sold to and also want to see when his wife gets money,where she deposits it & where the money ( and how much ) is going.we have been getting money yearly but it has continued to decrease even tho the company has incresed its business-also my father had set up that if the company increases our % would also increase-how do i get a copy of contract between my father and the company he sold to & how to get financials from his wife?

If you are in a partnership with these other parties, you almost certainly have a right to inspect partnership assets and documents. If the other parties do not comply, you could possibly obtain a court order to that effect. However, the status of the partnership, what happened to his estate after his death, and other other facts will play a role into what your options might be.

The starting point for your inquiry is the partnership agreement. That will establish your rights and determine who can request the infomation from the company that is paying the royalties. If you have a copy of that agreement, I can review it an give you a better answer.

I agree with Mike and John, that as a partner you have the right both to see all documents involved and, if necessary, sue the managing partner (seems to be your step-mother) for a full and complete accounting. Suit needs to be brought where partnership is located.
