Legal Question in Business Law in New Jersey

jewelery & book

I invented a new design for jewelery. What are the laws associated with that and how I can copyright my idea?

I also have an idea for a children's science book. How can I protect myself before I send my idea to companies?

Thank you very much.

Dmitry

Re: jewelery & book

Your jewelry may qualify for patent and/or copyright protection. Your book may qualify for copyright protection, but it is the expression that qualifies for copyright protection - see http://www.copyright.gov/circs/circ31.html So, an outline for the book, or a draft could qualify for copyright protection once fixed in a tangible medium. On the jewelry side, copyright law is will only protect that design of a useful article (like jewelry) to the degree that its pictorial, graphic, or sculptural features can be identified as existing independently of the utilitarian object in which they are embodied. The jewelry may be eligible for design patent protection.
