Legal Question in Business Law in New Jersey

town snack stand

We have a concession stand owned by our town, which stood closed & neglected for many years due to lack of volunteer interest. At the time it stood closed, it was there to fund a local organization which benefitted children in athletics, but this organization was never successful get it up & running for any length of time, thereby making little to no profit from this stand. I opened it up again 4 years ago, fronting the initial supplies with my own money & reimbursing myself only after I was able to re-supply properly & had enough left over to repay myself. This took about 2 months. It is now a thriving part of the community - cleaned up, fully stocked, updated, & the center of attention at our sports complex. I've also been able to make a profit each year, which have been turned over to the original organization. I would now like profits to fund a different town-wide organization; still benefitting the local children, but one that I feel is more befitting to the work that is being done. What rights, if any, do I have in making this decision? Have I earned any additional rights regarding decisions made simply by the time spent & improvements made at this concession stand?

Re: town snack stand

Presumably you have a lease or some other agreement with the Town that gives you the right to operate. If so, does the document limit the entity to which you must contribute the profits, or is the document silent on this. If there is nothing restricting you to what organization profits may be donated, you can give them to any organization. Best suggestion is to review this with the Town administration and get their formal approval to change organizations.
