legality of two jobs..`

I currently have a work from home type Consulting Job in IT. often I am at home without projects for months at a time. Can I get a second parallel job in IT in Pre-Sales also working from home. I think I can manage schedules. What is the legal advice, if some of my company finds out. Is it a loss of JOb or is there a jail term etc. please advise.

You should have a lawyer check any employment contract or non-competition agreements with your current employer. Provided that there is no contract violation, there should not be any impediment to your working elsewhere too. Even if there is a contract problem, your lawyer can help you decide what your other options may be. Your current employer cannot expect you to wait for assignments for long periods without doing something else.

It would not be criminal, but you would possibly lose one or both jobs. I assume you've signed a contract obligating you to not do this.
