Legal Question in Construction Law in New Jersey

Does The Contractors Registration Act apply to me?

If I worked as a Contractor and was not registered in NJ and started a job prior to December 31, 2005 does the The Contractors Registration Act apply to me. I was Subcontracted out for this job and unaware of the law at the time. The Contractors Registration Act was adopted in 2004 (and became effective on December 31, 2005) and states that no person shall offer to perform, or engage or attempt to engage in the business of making or selling home improvements unless registered with the Division of Consumer Affairs in accordance with the provisions of this act. [N.J.S.A. 56:8-138(a)] The enactment of this law was a further extension of the New Jersey Legislatures mission to protect consumers from fraudulent merchants and insure public safetyin this case, from contractors who were operating without licenses, proper insurance, and were taking peoples money without performing the services for which they were contracted.

The Act does not apply to subcontractors. If you worked for another contractor, you are okay.

Many in the trade register anyway even if they are usually subs. It gives them latitude to contract directly for finish and follow up work that the prime might not want to accept.

The key is did you contract with the home owner, or were you a sub to another contractor, in which case you should be OK.
