Legal Question in Construction Law in New Jersey

Unenforceable Contract

Can a contract be declared unenforceable if the contractor misreprented himself? ie Not registered, licensed, insured, etc. Can an arbitration clause become invalid. Is there a way to deem the contract void.

Thanks

Re: Unenforceable Contract

The answer in YOUR instance will depend upon the facts and the contract, but... yes, a contract can be declared unenforceable for several reasons, including fraud. All home improvement contractors MUST be registered/licensed, though not insured. Yes an arbitration clause can be invalid. Yes there are ways a contract can be declared void.

I'd have to see the contract and know the circumstances.
