Identity Theft

My identity was stolen, when the credit card company contacted me they said they would send affadavits so the account could be handled. After multiple phone calls the credit card company let the account go into collection, now i am trying to deal with them, and it has adversely affected my credit rating (which was perfect, before this incident). Can i sue the credit card co. to try and end this problem?

You may have claims against the credit card company under the Fair Credit Reporting Act and also the Truth in Lending Act(TILA). The statute of limitations (time in which you can sue) under these laws is relatively short so you must act quickly. You may also have claims against the collection agency for violations of the Fair Debt Collection Practices Act. If you would like more info, feel free to call me.
