insuance agent breach of fiduciary on the elderly

my dad's insurance agent borrowed $40,000.00 approx. 8 years ago for his own personal use not to my knowledge at the time. i have no paper work on this transaction between my father and this insurance agent, other than personal letters received from this agent saying he did personally borrow this money with verbal agreement to pay it back in 2002, ten years from the day it was borrowed. my dad is now deceased as is my mother and i can not get this agent to pay back this money. he started making payments but stopped. i have copies of all money orders sent to me (7) in the amount of $225.00 each. he will not send me a promisory note of payment and i now fear he will never pay this money. what can i do?
