Legal Question in Criminal Law in New Jersey

17 yr old sister charged with CDS in vehicle/now has to appear in superior court

my 17 yr old sister got arrested & charged with a CDS in her vehicle. 3 other kids were in her car & all got arrested. No one would confess to the seeds & stems that were found in the car so everyone was taken in. As she was being handcuffed,1 kid told my sis that the girl in the back seat swallowed it before she was searched. My sister did not know who had possession of the weed, because if she did, she wouldve said something as she was being arrested to save her! She just got a letter in the mail from the police officer that arrested her saying that she lied the whole time, and that she knew who had the weed in the car. Thats not true. This has to be taken to superior court now.

When my sister picked up the last girl at a local store, she ran inside real quick to use the bathroom. As she walked outside to her car, she saw a group of kids around her car. (she later found out they did an exchange, and that those group of kids sold a bag of weed to someone inside her car) she has no proof of this other than the videotape of her going inside the store. Its her word against the officer and the judge will most likely believe the cop. what can she say to get out of this? she needs to prove that she didnt know who had the weed.

Re: 17 yr old sister charged with CDS in vehicle/now has to appear in superior c

It is likely in the Superior Court because she is a juvenile, not because of the seriousness of the offense. In fact, while a violation of the law, if we are talking about a small amount of pot and your sister has not been in trouble before, it is a relatively minor offense.

With that said, I would unfortunately need to know much more about the facts of your case before giving a legal opinion.

I offer free consultations on these matters by phone or at my office in Cherry Hill. Please have your sister contact me so we can discuss the facts of her case and I can give her a better picture of the likely outcome and whether a lawyer might be able to assist.

Because your sister was under 18 even though this is a small amount of marijuana we are talking about it still has to go to the superior court as a juvenile matter. It may be a simple case, or it may be difficult. I need to see the evidence to give you better advice. Call me at 908-272-0111 for a free consultation. Thank you.
