Legal Question in Criminal Law in New Jersey

My ex boyf had a small amt of marijuana in the apt we used to share together. Although it wasnt mine Nj police arrested us both. this happened Feb 2012 it is now April 2013 and the lab still has not provided discovery. Do i have a fair chance of getting this charge dismissed from me? I have no prior records and have never been arrested ever.
