Legal Question in Criminal Law in New Jersey

My daughter has some serious drug charges for possession heroin in Ocean County, NJ. Her court date is next week. We need to work up enough money to get a good lawyer for her. If we get her into a detox program then immediately into a rehab will the court date be postponed?

We have wanted her to go to a 6 or 9 month rehab for a long time and hope this an acceptable way to do it. Because if not she is definitely going to prison for a long time.

If you get her into a residential rehabilitation program, the program will bring her to court when required. You should ask the program she applies to. There is also the drug court program for

defendants who commit crimes due to their drug addiction.

There is no guarantee that the court date will be adjourned. More, importantly great attention should be put towards finding her an appropriate sentencing so that she can secure her future and well being. I have dealt with these cases in Ocean County whereby the the crimes were being committed to get the drugs. Many of times what is called Special Probation, Drug Court or maybe just straight probation combined with private rehab is the greatest way to rehab a heroin addict and get them on a sober path. You don't say what the court date next week is for, i.e., arraignment, pre-trial hearing, sentencing, whatever. Can you get the court date postponed if your daughter is in rehab? Maybe, but she has to be in rehab and your lawyer has to request it from the judge and provide proof of her entry into rehab as well. I assume that your daughter is currently represented by the public defender, so you should probably ask this question of your daughter's public defender. It can never hurt to getv her into a rehab--she needs it, and if she believes it would help her case, she would be more inclined to do it...although she has to do it for herself....

I am experienced in matters of thjs nature and would be glad to help. Although I can't GUARANTEE the hearing date cold be adjourned, a court will most likely do it for a new lawyer entering the case, or a schedule conflict, or if more investigation might be needed...in other words, I believe it could be arranged, but time is of the essence....
