Legal Question in Criminal Law in New Jersey

misconduct charge

I confessed to taking about $13,000. I worked in a Township and the county charged me with 1 count of misconduct in the 2nd degree. Is this a manatory sentence at the state prison? I have never been in trouble before - not even a speeding ticket. Can this charge be changed to a lesser offence? I was in a county jail for 1 day and that was enough for me - please help!!

Re: misconduct charge

The original charge has a mandatory prison sentence upon conviction whether the conviction is as a consequence of a trial or a guilty plea.

It is feasible to avoid the prison sentence by taking aggressive action to convince the prosecutor's office that a prison sentence is not necessary and is not appropriate under the circumstances. You should call me immediately to discuss taking immediate action in this regard.

Re: misconduct charge

If you are found guilty of a 2nd degree crime, you are looking at 5-10 year in state prison. I would retain a criminal defense attorney as soon as possible and do not speak to anyone else until you do so. You are more than welcome to call my office for a free phone consultation.
