Legal Question in Criminal Law in New Jersey

pre trial intervention

Someone I know took PTI over a year ago and completed the program. The judge signed off on the completion in October. Does he have to go back to court for the charges now to be dismissed or will they be dismissed on their own after a certain amount of time. When he goes to look for a job these charges appear on his record it is becoming impossible to survive with them.

The charges should be dismissed. The person signs an order accepting the dismissal when they are admitted into PTI. At the end of the term, the judge signs it and the charges are dismissed. However, the charges are still on the person's record forever. If the person wants them off, they need to file for an expungement. Call me at 732/247/3340 for more info.

Except in rare circumstances, the charge is dismissed automatically once the PTI probation period is successfully completed. The defendant does not have to go back to court. However, the dismissal of the charge does not make the record disappear. The record remains forever, unless it is expunged. Charges that are dismissed on account of PTI completion are eligible to be expunged six months after the formal dismissal date. There should be an order dismissing the charges which was sent to your friend's attorney. He should call the attorney for a copy of the order. The arrest record can be expunged by filing a petition with the Superior Court of New Jersey.
