Pre-Trial Intervention

This is a question of what exactly is Pre-Trial Intervention? If someone does go through PTI does that mean that they will automatically have a criminal record during their term under PTI? And after successfully completing a term of Pre-Trial Intervention how does a defendant go about getting his/her record expunged?

Pre Trial Intervention (PTI) is a program that keeps you from having a criminal record. If you are entered into the PTI program then you do not have a criminal record during the period of time you are in PTI and if you successfully complete the program then you will not have a criminal record at all and therefore do not have to expunge your record. Pre-Trial Intervention is what is called a diversionary program whereby first offenders who are approved are offered a chance to participate in the program in lieu of pleading guilty/being found guilty of a crime. The program usually involves probation and/or drug/alcohol monitoring/counseling and the probation might last a year or a number of years.

During your probationary term, your record will show an arrest and "pending" as the outcome of those charges. Upon successful completion of P.T.I. your record will show the arrest and state that you completed PTI. While the charges are technically dismissed and you can answer that you have not been "convicted" of an offense it does not mean that your record is actually cleared.

I handle criminal record expungements and have handled expungements for people because they could not be employed with the PTI on their record or didnt even want potential employers to know about the PTI. You can expunge the arrest/PTI from your record six months after you successfully complete PTI/are formally discharged from PTI.
