Legal Question in DUI Law in New Jersey

Son charged with DUI (1st offense)

My son is 26 and was given a ticket for DWI on Sat. morning (3am). He was given a breathalizer and passed and was also asked to give a urine test. The police asked him to come back to the station 5 days later and was told (I overheard myself) that he was not DWI so they gave him a ticket for DUI. He was driving under the influence of prescription meds. I will admit, he does have a drug problem and I am glad he was stopped because it opened his eyes to needing to go into rehab, which he already called. I took his car away and told him when he gets out of rehab he can have it back. In the meantime, can the police change tickets like that? Another question; with him voluntarily going to rehab help his case since it was the 1st offense?

DWI and DUI fall under the same section of the law. If the lab tests show that the only drugs in your son's system were prescription medicines, then that would go a long way towards winning the case. And the fact that he voluntarily checked himself into rehab will certainly be favorable to him. I am an attorney who has handled many cases similar to this in various courts in NJ in the past. It must be proven that your son WAS UNDER THE INFLUENCE OF THE PRESCRIPTION DRUGS not just that he took some prescription drugs. They must prove impairment. Call me and I will explain.

Secondly, dwi includes being under the influence of alcohol or drugs.
