Legal Question in Entertainment Law in New Jersey

I am an independent singer songwriter and I noticed that my music is for sale on Amazon in Europe without my knowledge.

I have songs on the internet ,at many different music sites where people can listen and even download for free. My songs(4) where available on Amazon about 3 years ago through a company called Tunecore. For a small fee they were listed on several top music stores for one year(itunes, amazon etc.) After that year they were no longer listed and my contract ended. Now I see that two of my songs are still available at the European Amazon and Tunecore tells me that they have nothing to do with it. I have Copyrights and I had no knowledge of them being for sale for the past several years in Europe on Amazon.it and Amazon.es . They are selling for .99 cents for an mp3. Who is getting the money if a sale is made...it sure isn't me. Who do I have legal action against.

They are not listed in the U.S Amazon and I would have never known unless this fan from Italy told me they purchased my song on Amazon.it - edit

You should consider serving Amazon in the different European countries with a cease and desist letter. Another issue to keep in mind is whether you registered the copyrights for the song. In some European counties that is a requirement in others there is no such requirement. In the U.S. there is such a requirement if you intend to pursue the matter in court.

I can help you with serving Amazon with a cease and desist. Ping me off line.
