No Release form what rights do I have?

A person appeared and participated willingly in training videos, with the understanding that the videos were going to be sold...at the time i did not know anything about actor release forms. 5 years later when we are finally in a position to market and sell the training videos the person will not sign a release form.

Since i am sole owner of said training videos, what are my rights? Can i still sell the videos?

Can I sue them for not allowing me to sell the videos?

They never contributed one penny to production, now i may be forced to can the whole project with a lost of about $75,000. Can i sue them for said loss?

Please help! Any advice would be greatly appreciated.

Trying to file suit is not the correct way to proceed. You may be able to market the videos under an implied release since they appeared in the videos. Further, information is needed to give a good legal opinion on this matter.
