Legal Question in Family Law in New Jersey

I would like to change my last name to my boyfriends, but we do not want to marry. He receives a monthly death settlement payment from his previous wife passing away in a work accident. If he remarried he would lose that money and it helps us significantly financially. We were going to petition the court in NJ to change my last name to his and my daughters, for ease of caring for my daughter. I am not doing it to avoid creditors or to commit a crime. Is it legal to change my name to his last name without marriage?

You are permitted to change your name for any number of reasons. If you are doing so to avoid criminal proceedings or creditors, you are not. The Court could also bar it if the judge felt that there was some fraudulent reason. It does not appear to me that you are doing this for anything but your own personal reasons, which is acceptable. You should see an attorney to determine the manner in which to proceed.
