Legal Question in Family Law in New Jersey

Child Support

My ex boyfriend has a court order to pay me child support for our two children, provide medical benefits and see them every other weekend and every Wed.He has not seent the kids in over a year and has lost his medical benefits. He is in arrears of almost $10,000.00. He has no job and no more unemployment left he was supposed to apply for Disability but has not done so to my knowledge. The court system seems to do nothing what can I do to try and get this man to fulfill his obligations? The state does nothing to help a struggling single mother. Can I sue the County or take them to court for not helping me? Please advise me on what to do.

Thank you

Re: Child Support

Let me first address your question about a suit against the County for not helping you. You have described a man who is clearly irresponsible, to say the least. The County cannot force him to find a job or see his kids. It seems that the fault here is with your ex and not the County.

Leaving that aside, you can file an application, with the assistance of Court personel, to hold him in contempt for failing to live up to his responsibilities. If the Court were to find that he is truly able to work and is just refusing, they may put him in jail until he agrees to comply and/or comes up with some money. Or, you can hire an attorney to try to force him to do what he is supposed to do. In either case, unfortunately, you will need to be the one to force the issue, by filing a Motion either on your own or with the assistance of an attorney.

Keep in mind that this advice is given based on the little bit of information that you have provided in your question. My advice may change based on other information. Further, no one can rely on advice from an attorney who has not been retained. You cannot rely on this advice because we have not personally met and you have not retained me as an attorney. If you have not already done so, you should immediately meet with a Family Law attorney for a full consultation before you take any further steps. Good luck! Rob Gleaner
