Legal Question in Family Law in New Jersey

College woes

Child graduates from college in May,2002. 23 years old.

Applied for another 9 month continuation to get license.

Support payments were suppose to stop in May. Being told that I must continue to pay by ex-spouse. If I make an offer that my child come live with me, have room available,for this additional schooling and I would gladly pay her cost and she turns me down with this offer am I still obligated to pay the full amount of $500.00 per month

or could I have this reduced, or is there any other alternitives?

Thank you for your e-mail. Normally, after a child graduates from a 4-year college with a degree, there are no financial responsibilities for support by either parent. There may be exceptions such as an agreement between you and the spouse (or child) that you would pay for additional schooling or licensing. There could be other exceptions as well. In the usual situation, however,there is no obligation for support or tuition for post-graduate education - especially if the child is over 21. I hope this answer has been helpful to you. Thank you for your inquiry. Please be advised that I have not been retained to represent you and I am basing the information provided on the limited information you supplied.

However, the law provides no obligation for either spouse to pay for college or graduate school. It depends on your divorce agreement. Do the terms of your agreement provide that you pay for college and/or graduate school? Whether they do or not, it sounds as if your obligations can be reduced at this time, but I would need more information and there is never a gurantee.
