Delclaring An Adult Parent Legally Incompetent

My sister and I need to have our father declared mentally and physically incompetent to care for himself. He is a war vet, has physical disabilities, and lives in horribly unsuitable and unsanitary conditions. He refuses our help, but is in serious need of assistance. We have tried to secure alternative housing and medical treatment for him, but again, he refuses. We also need to take control of his finances (which is only a disability check) because he mismanages his funds (e.g., does not pay rent, will not pay his bills, buy food, etc).

He is loosing an extreme amount of weight, cannot walk well due to deterioration of his spinal nerves, and has a drug dependency. All of these items can be proven.

What are our steps? How can we get guardianship of him, and ensure that he gets the treatment and assistance he needs before its too late?

You will have to file an action in the Chancery Division of the Superior Court of New Jersey. You also need to have a psychiatrist visit with your father if your father will not go to the psychiatrist for an evaluation.
