Divorce with my wife and cutody of my child
I would like to get divorce from my wife, in India. We live in New Jersey
Now, My wife wants to send our only child to her parents house in India. Is there a way I can avoid it. The child is 3 months old.

You should file for divorce immediately, and in your papers, ask the court to determine custody of the child. Because of the issue with your child, I would not suggest you handle this pro se, but retain an attorney. Custody battles can be long and complex.

you would have to file for temporary custody with the nj courts. you should probably do this prior to filing for divorce. i wasn't sure from your question if you need to get the divorce in india or nj. you would have to contact a lawyer who is able to practice in india for help with an international divorce. if you want to get divorced in nj, there are certain statutory requirements that must be met - residency, grounds for divorce, etc. feel free to call me at 609 263-0089 if you have any further questions. good luck !!
