Legal Question in Family Law in New Jersey

equitable distribution

Married 15 years+. Wife 41 I am 56 yrs. old.She filed for divorce and wants 50% of equity in marital residence. I supported her and her son (from previous) while she earned degree in dental hygene. I used funds from premarital house sale to purchase current marital residence. (I know, co-mingled so no recourse) However, she was NOT ''home make'', has worked full time for past ten years earning over 50 thousand per year. I have made every mortgage, interest, tax and utilities payment for past 15 years. Again, she worked full time and her money was hers and hers alone. She NEVER contributed one dime toward the purchase, maintainance or payments on residence. We don't even had joint checking account. Have the courts been known to distribute equity, based on these untraditional conditions, not at 50-50? As far as I am concerned, I don't think she should be entitled to any more than 20or 25%, if even that where as she paid for nothing except for some occasional groceries. All the rest of her money was spent on her and her son. I have copies of all mortgage and utility bills for past 15 years proving this.

Re: equitable distribution

There is a possibility of less than a 50-50 split. That's why it is termed "equitable distribution" and not equal distribution. However, it sounds as if you will need an attorney because the arguments may be better stated if done by an experienced attorney.
