Legal Question in Family Law in New Jersey

Can I Be Extradited to India for Anti-Dowry Case Pending In India

hi

i work on a temporary visa (H1-B) in the U.S. I got married in New Delhi in 1998. My wife joined me in the U.S. in Jan 2000. Very soon I realized she had suicidal tendencies and could harm me or herself. After reasoning with her for sometime, she left for India in Nov. 2001. She abused, threatened my family in India---and returned again to the U.S. in Oct 2002 only to stalk and harass me. At this time I filed for divorce while she was here. She accepted the summons and even countersued me for money and some baseless allegations. Meanwhile she also returned to India and filed a false anti-dowry and harassment case against me and my family--in retaliation. Recently I received my divorse in New Jersey.

My in-laws, who are politically well-connected, have recently managed to get warrants in my name in India and have now approached the Ministry of External Affairs to force me to come to India. What are the chances of me being extradited to India? I hold an Indian passport. If that is the case, what is the immediate step I can take for my well-being. What is the precedence is such cases. Plz Help.

thanks very much

You need to contact a lawyer who specializes in immigration law. I do not. Good luck.

The question is whether you can be extradited to India for an offense which does not exist in the United States of America. Considerable research is required, but I would think not

There is the question of whether public policy of this country would allow extradition to India on such an offense.

I do not think that India could revoke an immigration status granted to you by this country.

I would suggest that you call my office at 800 273 7933 to arrange a consultation.
