fighting emancipation

My ex-husband has applied to court tohave my 18yr & 19yr old sons declared emancipated, to stop support and medical coverage- They are both in school, one in college full time and the 18yr old is in technical school full time. they both live with me. Can I oppose this emancipation? How?

Re: fighting emancipation

Based on the facts that you have provided to me, it does not appear that either of your children have met the legal standard in NJ for emancipation. You will need to provide the appropriate proofs to the Judge showing full time educational status for your children at the time of the hearing on the Motion. Keep in mind that this advice is based purely on the little bit ofinformation that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. You need to contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. If you call me, [856-546-8010] mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner
