Legal Question in Family Law in New Jersey

Hi-

Can you please tell me what happens when a parent ordered to pay child support turns 62 and the minor child begins to receive a social security check? What happens to the child support order? Must the parent continue to pay the support ? Thank you.

This is considered to be a "substantial change of circumstance" and child support should be recalculated based on the income situations of the parties. The money being received by the child would be a credit against the child support obligation. But you really should see an attorney to make a determination of what the proper outcome should be.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you should contact a family law attorney to discuss your matter in more detail. Only then will you be able to rely on the advice. Good luck!
