Our house is going to foreclosure, no one lives there. I want to deed it over to my wife as part of divorce, but I want to get my name off the mortgage note. How do I do that?

So you want to give your soon to be ex a house that she can do nothing with? I assume you have an attorney for the divorce. He or she should be advising you on all of this.

The only way to get your name off the mortgage would be to have her refinance and buy you out of your share. Since the house is in foreclosure, I'm assuming that this is not going to happen. Is the house on the market? Have you considered the sale, even if it is a short sale? Please contact my office to discuss possible options. My telephone number is 732-663-1500.

Thank you.
