husband moved out and took all his belongings and still feels he can come here anytime he feels because he pays the rent. It doesn't matter if I'm home or not. He was cheating on me. we have been married for 35 years

He actually can come and go when he wants. It was and still is your common home as long as you are both on the lease. It's time for you to consult with an attorney and get the divorce going.
