Legal Question in Family Law in New Jersey

can husband get in trouble?

My husband filed a restraining order against me about 18 months ago. I moved into my inlaws house. I moved back into our house with my husband about six months ago. He still has the restraining order and refuses to remove it. I know I can get in trouble because the order is against me but can my husband also be charged for allowing me to move back while the order is in place? Thank You.

Re: can husband get in trouble?

No, there is no "charge" that your husband can be accused of. However, as to you, as you noted, you can be charged with violation of the restraining order. I would strongly suggest that you contact an attorney to discuss filing a motion /order to show cause seeking to vacate the restraining order based on the fact(s) that you have been back with your husband for a number of months. I would be cautious about dealing with your husband since he refuses to voluntarily dismiss the restraining order. It appears he wants to retain that control over you which can only work to your detriment.
