In New Jersey, can a non-custodial step parents income be used to determine the non-custodial parent's financial ability to pay for college tuition?

Perhaps, but not usually. I agree with the other attorney that it can only be used to limit the argument about paying for other expenses, but in the State of New Jersey, a parent�s obligation to provide toward the higher education of a child of the parties is generally determined pursuant to the factors set forth in Newburgh v. Arrigo, 88 N.J. 529 (1983). There is alot of money at issue in these types of cases and I also agree you should seek the advice of an attorney.
